1. General Provisions

1.1. This License Agreement (hereinafter referred to as the "Agreement") governs the relationship between any person using the browser-based online game "Sword and Staff" (hereinafter referred to as the "Game" or "Program") located at https://swsf.ru (hereinafter referred to as the "User"), and the Rights Holder - Kononov Konstantin S. (ditsfree@gmail.com) (hereinafter referred to as the "Rights Holder").

1.2. By starting to use the Program (by registering an account, accessing the gameplay, etc.), the User confirms that they have fully read the terms of this Agreement and accepts them without any reservations. If the User does not agree with any terms of the Agreement, they are not entitled to use the Program.

1.3. The Rights Holder has the right to unilaterally change the terms of this Agreement. The new version of the Agreement comes into force from the moment it is posted on the Website. Continued use of the Game after changes are made means the User's agreement with the new version of the Agreement.

2. License and Intellectual Property Rights

2.1. The Rights Holder grants the User a free, non-transferable, simple (non-exclusive) license to use the Program in the following ways:

• Using the Program for its direct functional purpose
• Creating one game account and managing a game character
• Using in-game communication tools (chat, forum) for personal non-commercial communication

2.2. All intellectual property objects related to the Game (code, graphics, design, names, characters, plot, "credits", "euro-credits" and other virtual items) are the property of the Rights Holder. This Agreement does not imply the assignment or transfer of any exclusive rights to the User.

3. Virtual Goods and Payments

3.1. The Game contains virtual goods: "credits" and "euro-credits" (hereinafter referred to as "Virtual Goods"). These terms are used to designate in-game licenses for using functionality and are not monetary funds or other property.

3.2. The User is not the owner of Virtual Goods and cannot exchange them for real money, demand a refund, or consider them their property. All rights to Virtual Goods remain with the Rights Holder.

3.3. Payment for Virtual Goods is made through third-party payment services. The Rights Holder is not responsible for the actions of payment aggregators. All disputes related to payment processing are resolved by the User directly with the selected payment service.

4. User Responsibilities and Restrictions

4.1. The User undertakes to:

• Provide accurate data during registration, including email, mobile phone number, date of birth
• Immediately notify the Rights Holder of any discovered errors (bugs) in the Game
• Comply with the legislation of the Russian Federation and respect the rights of other Users

4.2. The User is PROHIBITED from:

• Using bot programs, macros, automatic scripts, mods, server emulators
• Using Game errors (exploits)
• Posting illegal, offensive content or content that violates copyright
• Impersonating another person or representative of the Rights Holder
• Performing actions aimed at disrupting the operation of the Game or servers

4.3. The User is fully responsible for all actions performed under their account, as well as for any content they publish in the Game (messages, photos, videos, links).

5. Personal Data Processing

5.1. When registering in the Game, the User voluntarily provides the Rights Holder with the following personal data: email address, mobile phone number, date of birth, links to social networks and messengers.

5.2. The Rights Holder has the right to automatically collect technical information: IP address, device type data, game session statistics, information from "cookie" files.

5.3. Purposes of data processing:

• User identification and providing access to the Game
• Communication with the User, sending notifications and responses to requests
• Conducting analytics and improving the Game's operation
• Targeted advertising and marketing mailings (with the User's consent)

6. Liability and Disclaimer of Warranties

6.1. The Program is provided "as is". The Rights Holder does not give any guarantees that the Program will work uninterruptedly and without errors.

6.2. The Rights Holder is not responsible for:

• Temporary malfunctions in the Game's operation related to technical problems
• Actions of Users, including the content of their messages and publications
• Any indirect losses or lost profits of the User

6.3. For violation of the terms of this Agreement, the Rights Holder has the right to apply the following measures to the User: warning, temporary account blocking, permanent ban, reset of game progress.

7. Final Provisions

7.1. All disputes arising from this Agreement shall be resolved in the court at the place of residence of the Rights Holder.

7.2. The User confirms that they have reached the age of 18 and have no restrictions on receiving gaming services under the legislation of their country.

7.3. The current version of the Agreement is always available on the Website.
